The 60 day notice without accommodation for future uncertainty with regards to moving plans is overly restrictive. It does not allow the tenant to provide a safety net for themselves without out either breaking contract or paying for unused time in the apartment. This is exacerbated by a lack of pro-rating to help cushion the financial blow when one chooses to go month-to-month as a safety precaution to make sure they don't become homeless and find they don't need the extra month after all, and are forced to pay a full month's rent for nothing. Though the obvious intent is to protect the apartment's interest in keeping apartments filled, it comes at the ill-gotten expense of the tenant. This should be rectified soon as many in the area can not bear the financial burden well if at all.
My personal experience is being told that I could not give my 60 day notice 60 days before the contract ending if I wanted to be able to rent month-to-month. Subsequently I chose to give my notice 30 days before end of contract (60 days notice if including the extra month) so that, in the case I could not close on my new house in time, I did not become homeless and seeing no other option. Then when I do manage to not only close in time, but am granted the ability to completely vacate the apartment before the start of the final month, I am offered no pro-rating, and am forced to essentially flush $1100 into an empty apartment.
